Terms and conditions

The German original is called „Allgemeine Geschäftsbedingungen“, usually shortened to AGB. The section numbers („§ 1“ and so on) are the same in both versions, so you can compare them line by line.

About this translation

This is a convenience translation. The contractual relationship is governed by German law, and the German version of this text is the legally binding one. Where the two versions differ, the German version prevails. You will find it linked in the footer of every page.

§ 1 Scope and contracting parties

These terms apply to every contract for the use of Fishbot concluded between you and PLATZHALTER — dein voller Name, PLATZHALTER — Straße und Hausnummer, PLATZHALTER PLATZHALTER — Ort.

A consumer („Verbraucher“) is anyone who enters into the contract for purposes that are predominantly outside their trade, business or profession. A trader („Unternehmer“) is anyone acting in the exercise of such an activity. Terms of the customer that differ from these do not become part of the contract unless we expressly agree to them.

§ 2 Subject matter of the contract

Fishbot is a Discord bot provided as a service. The customer invites the bot to a Discord server and configures it through the web dashboard; there is no software to download or install.

The scope of the service follows from the modules booked. Which modules are booked can be seen in the dashboard at any time. A contract always covers one Discord server and cannot be transferred to another server.

Modules marked as free are available without a contract and without any payment obligation. There is no entitlement to their permanent availability.

§ 3 How the contract is concluded

The presentation of the modules on the website is not a binding offer but an invitation to order.

You add modules to the cart, choose the term and the server, and submit a binding offer by clicking Zahlungspflichtig bestellen — German law (§ 312j BGB) prescribes this exact wording for order buttons, so the button stays German; it means “order with obligation to pay”. Before that click you see every item listed separately and can still change or remove any of them.

The contract comes into effect as soon as we confirm the order by email or the modules booked are unlocked — whichever happens first. We store the text of the contract; you receive it with the confirmation.

§ 4 Prices and payment

Under § 19 (1) UStG (the small-business rule of the German VAT Act) we do not charge VAT, and none is shown on the invoice. All prices quoted are therefore final prices — nothing is added at checkout.

Payment is handled by Stripe. Which payment methods are available is shown during checkout. For subscriptions the amount falls due at the start of each billing period; for prepaid terms it falls due once, when the contract is concluded.

If a charge fails, Stripe retries it several times and informs you. If payment is still not made, we may suspend the paid modules until the arrears are settled.

§ 5 Term and termination

Type of bookingTermEnd
Monthly subscriptionone monthrenews by one month at a time, can be cancelled at any time with effect from the end of the current month
Annual subscriptiontwelve monthsrenews by twelve months at a time, can be cancelled at any time with effect from the end of the current period
Prepaid termthe period paid forends automatically, no cancellation needed and no automatic renewal

You can cancel subscriptions at any time in the dashboard — no reason required and no detour through support. Once a contract ends, the server falls back to the free modules; your settings remain stored.

The right of either side to terminate for good cause without notice remains unaffected.

§ 6 The customer's obligations

  • The bot may only be used in line with Discord's terms of service and guidelines.
  • You are responsible for the content you distribute through the bot and for the permissions you grant it on your server.
  • The service must not be used to harass others, to distribute unlawful content or to circumvent Discord's APIs.
  • Access credentials and API keys must be kept confidential.

In the event of serious or repeated breaches we may suspend access for the server concerned. Before a permanent suspension we will normally point the breach out and give you an opportunity to comment — unless there is an urgent risk. Amounts already paid for the suspended period are refunded pro rata if the customer is not responsible for the suspension.

§ 7 Availability

We aim for continuous operation but do not guarantee any particular level of availability. Where possible we announce maintenance in advance in the support Discord.

Outages caused by problems at Discord are outside our control. If the service is unavailable for a longer continuous period for reasons within our responsibility, we refund the fee for that period pro rata.

§ 8 Changes to the service and to prices

We may develop the service further and add modules. If a module you booked is discontinued or restricted in its core function, we will inform you at least 30 days in advance; you may then terminate for good cause and will be refunded amounts already paid for the unused period.

Price changes are announced in writing at least six weeks before they take effect. You may terminate with effect from the date of the change at any time until it takes effect. For terms already prepaid, the price that applied at the time of booking always remains in force.

§ 9 Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act (Produkthaftungsgesetz).

In cases of ordinary negligence we are liable only for the breach of material contractual obligations — those whose performance makes the contract possible in the first place and on which you may regularly rely — and only up to the amount of the foreseeable damage typical for this kind of contract. Liability is otherwise excluded.

For the loss of data we are liable only to the extent that the loss would have occurred had you carried out proper and regular backups.

§ 10 Right of withdrawal

Consumers have a Widerrufsrecht (statutory right of withdrawal). The details are set out in the withdrawal policy, which you can reach from the footer of every page.

§ 11 Final provisions

The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. For consumers this choice of law applies only in so far as it does not remove the protection granted by the mandatory provisions of the country in which the consumer has their habitual residence.

If the customer is a merchant, a legal person under public law or a special fund under public law, our place of business is the place of jurisdiction.

Should any provision be invalid, the rest of the contract remains in force.
